Terms of Service

1. About these Terms

These Terms of Service ("Terms") are an agreement between you and AbcTeck, LLC, a Florida hosting provider that operates ABC Teck Hosting ("ABC Teck," "we," "us"). They cover your use of abcteck.com and our hosting services.

By creating an account or using our services, you agree to these Terms, our Acceptable Use Policy and our Privacy Policy. If you do not agree, do not use our services.

2. Eligibility and your account

  • You must be at least 18 to open an account. A parent or legal guardian may open an account for a minor; the parent or guardian is then the account holder and is responsible for the account under these Terms.
  • Give us accurate information and keep it current, especially your email address. That is where we send billing and service notices.
  • Keep your login details secure. We strongly recommend turning on two-step sign-in.
  • You are responsible for all activity under your account, including by anyone you give access to.
  • Tell us right away at support@abcteck.com if you suspect someone has accessed your account without permission.

3. Our services

We provide shared web hosting, email hosting and free SSL certificates, as described on our plans page. We do not sell or register domain names. You keep your domain with your own registrar and point it to us.

We may change or improve our services over time. If a change materially reduces what your plan includes, we will email you at least 30 days before it takes effect. You may cancel before then and receive a prorated refund for any unused time you have paid for.

4. Acceptable use

You must follow our Acceptable Use Policy, which is part of these Terms. It lists what you may not host or do on our servers, including spam, malware, phishing and illegal content. Serious violations can lead to immediate suspension, as described in Section 13.

5. Billing, payment methods and price lock

  • Plans are billed in advance, monthly or annually, as you choose at checkout. Annual billing costs the equivalent of ten months.
  • We accept credit and debit cards and PayPal. You can also pay from any account credit on your account.
  • Your plan renews automatically at the end of each billing period until you cancel. You can cancel at any time (Section 8).
  • Price lock: your plan renews at the price you signed up at for as long as it remains active, whether you pay monthly or annually. Prices for new customers may change, but that never changes the price of an active plan. If you change to a different plan, that plan's price at the time of the change applies from then on. Promotional discounts apply to the first payment only.
  • Add-ons are billed with the same payment method and renew the same way. Add-on prices may change with at least 30 days' notice by email.
  • Prices shown do not include any taxes that may apply. If tax applies, it is shown before you pay.

6. Failed payments

If an invoice is not paid by its due date:

  • 5 days past due: we send a late notice. Your services keep running.
  • 10 days past due: we send a final notice. Your services keep running.
  • 15 days past due: we suspend your account. Your sites and email stop working.
  • To reinstate a suspended account, you must pay the full past-due balance plus a $15.00 reactivation fee. Service is restored once both are paid.
  • 60 days past due: if the balance is still unpaid, we terminate the account and permanently delete all of its data, including files, email, databases and backups. Deleted data cannot be recovered.

7. 30-day money-back guarantee and refunds

If you are new to ABC Teck and cancel a hosting plan within 30 days of your first payment, we refund what you paid for that plan and its add-ons in full. The guarantee applies once per customer and does not apply to accounts suspended or terminated for violating these Terms or the Acceptable Use Policy.

After the first 30 days, you can cancel any plan or add-on from your dashboard in one of two ways:

  • At the end of the billing period: it keeps working until the period you paid for ends, nothing more is charged, and nothing is refunded.
  • Immediately: it stops at once and we refund the unused, prorated part of the current billing period.

Payments made with account credit are refunded as account credit. Payments made by card or PayPal are refunded to that card or PayPal account, or as account credit if you prefer. Card and PayPal refunds usually take 5 to 10 business days to arrive. One-time purchases, such as a one-time backup, are not refundable once delivered.

8. Cancelling

You can cancel at any time from your dashboard or by emailing support@abcteck.com. There is no contract and no cancellation fee. Refunds follow Section 7.

Cancelling only a card or PayPal subscription outside your dashboard stops future payments, but it does not close your account; the account then follows the failed-payment steps in Section 6. To close your account cleanly, cancel from your dashboard.

Download anything you want to keep before your service ends. Section 14 explains what happens to your data.

9. Uptime commitment and credits

We aim for 99.9% uptime each calendar month on shared hosting, measured by our own monitoring. If we miss it, you can ask for a credit toward your next bill:

Ask for a credit within 30 days after the month ends by emailing support@abcteck.com.

Uptime does not count scheduled maintenance announced at least 48 hours in advance, problems caused by your own code or settings, enforcement of the Acceptable Use Policy, or events covered by Section 20. Credits apply to future bills only, cannot be exchanged for cash, and are your only remedy for downtime.

10. Your content

You own everything you store on our servers. You give us permission to store, copy, transmit and display it only as needed to run and protect the service, for example serving your site to visitors and keeping backups.

You are responsible for your content and must have the rights to host it. If your site collects information from its visitors, you are responsible for your own site's privacy notice. Our Privacy Policy explains how we handle that data on your behalf.

We do not routinely monitor customer content. We do act on reports, and we may review or remove content when needed to enforce the Acceptable Use Policy, protect our systems or other customers, or comply with the law.

11. Backups

  • Starter: automatic weekly backups. The four most recent are kept (about one month); each new backup replaces the oldest.
  • Pro and Business, and Starter with the daily backup add-on: automatic daily backups, each kept for 14 days; each new backup replaces the oldest.
  • Backups can be downloaded or restored from your dashboard, or restored by support request.

Backups are a convenience for recovering from accidents, not a guarantee. They can fail or miss recent changes, so keep your own copies of anything important.

12. Copyright complaints (DMCA)

We respond to notices of copyright infringement under the Digital Millennium Copyright Act. Send notices to our designated agent at dmca@abcteck.com. A notice must include:

  • Your physical or electronic signature.
  • The copyrighted work you believe was infringed.
  • The material you believe infringes it, and where it is, such as a URL.
  • Your name, address, phone number and email address.
  • A statement that you believe in good faith the use is not authorized by the owner, its agent or the law.
  • A statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for the owner.

When we receive a valid notice, we remove or disable access to the material and tell the customer. A customer who believes it was removed by mistake may send a counter-notice to the same address. We forward it to the person who complained and may restore the material in 10 to 14 business days, unless they tell us they have filed a lawsuit. We terminate the accounts of repeat infringers in appropriate circumstances.

13. Suspension and termination by us

We may suspend or terminate your account immediately, without notice, if:

  • you seriously violate the Acceptable Use Policy, for example with spam, malware, phishing or illegal content;
  • your account threatens the security or stability of our servers or other customers, including when it has been compromised; or
  • the law requires it.

For less serious problems, we will usually warn you first and give you a reasonable chance to fix them. A suspended account can be restored once the problem is fixed. You can appeal a suspension by emailing appeals@abcteck.com within 14 days.

We may also stop serving you for any other reason by giving at least 30 days' notice by email. In that case, we refund any unused time you have paid for. Accounts terminated for violating these Terms or the Acceptable Use Policy do not receive a refund.

14. What happens to your data

  • Deleting a domain or website from your dashboard permanently deletes its files, databases and email at once. It cannot be recovered unless you have a backup.
  • Closing your account, or termination under Sections 6 or 13, permanently deletes all of your data, including all backups.

We may delete content sooner, or keep it longer, when the law requires it. For example, illegal content may be removed immediately or preserved for law enforcement.

15. Privacy

Our Privacy Policy explains what we collect and how we use it. It is part of these Terms.

16. Disclaimer of warranties

EXCEPT AS STATED IN THESE TERMS, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

17. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABCTECK, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO OUR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under Florida law.

18. Indemnification

You agree to indemnify and hold harmless AbcTeck, LLC from any claims, damages or expenses, including reasonable attorneys' fees, arising from your content, your use of our services, your violation of these Terms, or your infringement of anyone else's rights.

19. Governing law and disputes

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules.

Before filing any claim, email legal@abcteck.com so we can try to resolve it informally within 30 days. If we cannot, any dispute will be resolved exclusively in the state courts located in the county of AbcTeck, LLC's principal place of business in Florida, or the federal court for the district that includes that county. You and we consent to those courts' jurisdiction. Either of us may instead bring an eligible claim in small claims court.

20. Events beyond our control

We are not responsible for delays or failures caused by events beyond our reasonable control. Examples include hurricanes and other natural disasters, power or network outages at our providers, attacks on our network, and government action.

21. Changes to these Terms

We may update these Terms. For material changes, we will email you at least 14 days before they take effect and post the new version with its effective date. If you keep using our services after that date, the new Terms apply. If you do not agree, cancel before then.

22. General

  • Entire agreement: these Terms, the Acceptable Use Policy and the Privacy Policy are the whole agreement between us about our services.
  • Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver: if we do not enforce a term right away, we can still enforce it later.
  • Assignment: you cannot transfer your account without our written consent. We may transfer these Terms if our business is sold or reorganized, and we will tell you if that happens.
  • Notices: we send notices to your account email. You can send notices to legal@abcteck.com.
